Southwind Rule and Covenants 

Southwind Board Resolutions:
 
POA Board Resolutions -A board resolution is a formal document that officially memorializes a decision made by the HOA board. It is a more specific, action-oriented document than a policy. A resolution is often used to adopt a new policy. This involves the formal act of the board voting to approve and adopt a new policy, such as a fine schedule or collection policy.
If the community's governing documents (like the CC&Rs or bylaws) are unclear on a certain issue, the board can pass a resolution to provide an official interpretation or clarification. A "special resolution" can be used to handle a unique circumstance that isn't covered by existing rules.

Fines and Liens:  
 
Don't hesitate to contact our Association Property Manager for additional information on our enforcement procedures and fines, to report a covenant or rule violation, or to request a waiver.
 
Fine and Lien Process: At a minimum, the Association Property Manager completes weekly community inspections. When a compliance issue is noted, the Southwind Property Manager process provides the Owner with a written courtesy notice of a violation and requests compliance.  Normally, this is sufficient to correct the violation.  If the issue is observed a second time with no action, a second written notice of violation is sent, citing the rule and warning of the potential for a fine if the issue is not corrected.  If the issue is observed a third time, the Property Manager brings it to the Board for consideration.  The property manager tracks violations and their status in the monthly reports to the board.  Fine and Lien Guidelines are in our Covenants, Conditions, and Restrictions in accordance with applicable Florida law.
 
 
SPOA Rules governing Golf Carts, Low Speed Vehicles and E-Bikes:
 
Southwind POA governing documents (5.19) require Golf Carts and Low Speed Vehicles (LSV) to comply with Florida Law.  Section 320.01(41), Florida Statutes, defines LSVs as “any four-wheeled vehicle whose top speed is greater than 20 miles per hour, but not greater than 25 miles per hour.”  LSVs must be registered, titled, and insured with personal injury protection (PIP) and property damage liability (PDL) insurance. Any person operating an LSV must have a valid driver's license in their immediate possession.  The Association Board of Directors also adopted a policy that requires E-Bikes to comply with Florida Law (316.20655 Electric bicycle regulations 6.10.25).
 
 
In addition to the architectural guidelines, the following residential rules apply:
 
Holidays
 
Contracting Services:
A resident may clear a contractor to enter; however, work may be performed only between 7 am and 6 pm, Monday – Friday (except in emergencies), and 9 am to 6 pm on Saturday. Additionally, no work may be performed on the Holidays listed:

Pets. Residents are limited to common household pets; no other animals, livestock, or poultry are allowed. Pet owners are responsible for ensuring that their pets are not allowed to roam and don’t exhibit “public nuisance” behavior such as chasing cars, harassing someone, or barking excessively. Dogs must be on a physical leash at all times.  Pet waste shall be removed and disposed of properly. 
 
Trash Services. Trash containers may not be visible from the front of the house nor the back of homes on lakes and golf courses. Refuse and recycle containers and yard waste can be placed curbside the evening before scheduled pick up, not before. To schedule bulk pickup or for questions about recyclables and yard waste requirements, call WMS at 862-7141. Our schedule (excluding major holidays):

Residential parking. Residents and guests shall park in accordance with Florida Statutes § 316.195, and 5.18 of our governing documents. Parking rules are strictly enforced.  Key excerpts follow:
 
• Parking on the street, except for temporary parking.  Every vehicle stopped or parked upon a two-way roadway shall be so stopped or parked with the right-hand wheels parallel to and within 12 inches of the right-hand curb or edge of the roadway.
• Parking on the grass or unimproved areas is not permitted.
• Overnight street parking is strictly prohibited.  
• Only registered wheeled vehicles (automobiles, low-speed vehicles, and motorcycles), excluding motor homes, trailers, boats, riding lawnmowers, unregistered golf carts, etc., shall be parked in the front driveway.  
• Disabled or unlicensed vehicles are permitted in garage parking only.  Short-term covered parking in a driveway is permitted for protection from the elements, but shall not be used for storing vehicles.   
 
Note: Residential Street Parking should be limited to allow unrestricted access to emergency and vendor support vehicles.  Overnight parking on the street is not permitted and is subject to fining or towing in cases where the vehicle is creating a hazard.
 
 
Signs, Flags, Banners.
No more than one sign or flag may be placed on a Lot, except for federal or state flags, as provided in section 720.304, Florida Statutes. No sign shall exceed six square feet. A sign may not be displayed on a Lot for more than thirty days in any one six-month period, except for the following:
  1. A “For Sale” or “Sold” sign shall be permitted for as long as the Lot is being openly marketed and shall be removed following closing and within seven days.  One additional sign may be placed on the back side of golf course lots.  No such signs shall exceed six square feet in size.
  1. A single sign identifying the contractor doing construction work on the lot shall be permitted as long as construction is ongoing.  No such sign shall exceed six square feet in size.  No sign shall be affixed to any trees on the lot or the road's right of way.  
  1. Small security/home protection signs, parking/pet, and temporary 24-hour lawn chemical application signs are exempt from this restriction.
Garage/yard/estate sales. Events of this type are not permitted due to limited parking. 
 
Open Houses.
 
A traditional "For Sale" Open House is permitted on Saturdays or Sundays.  Each resident may use a four-hour block between 09:00 AM and 5:00 PM. Prior registration and property manager notification are required.  The Property Managers may provide an active short-term gate code for the open house day.  Signage is not permitted on Southwind Common Property.  
 
On weekdays, a "Gated community home showing" may be considered.  Here, interested parties contact the listing agent or their office before coming to the listing home for sale.  They are provided a Visitor Gate Access Code, which the agent coordinated with Southwind.  The difference is that potential buyers are screened instead of people appearing unannounced.  Most importantly, the agent is responsible for the limited access code and its users.  The potential buyers notify the attendant that they are meeting the agent for a home showing at the address they are going to, and we have a Visitors Gate Access Code.
 
Trespassing on Private Property.
Trespassing complaints by a homeowner should be reported to the Okaloosa Sheriff's Department at (850) 651-7400.  Please note that walking between the hours of 7 am - 7 pm, riding bikes, and playing on the golf course anytime without permission is trespassing.  Neither our Greenspace Agreement nor our current financial contribution provides any rights to access the golf course without permission.
 
Pet Complaints.
Panhandle Animal Welfare Society (PAWS) handles pet complaints for Okaloosa County and Southwind Residents.  PAWS offers affidavits for reporting animal ordinance violations.  Owners and residents are encouraged to resolve complaints amicably and to notify the property manager if an affidavit is filed.
